1. Scope of Services
TFJ Buycycle GmbH ("buycycle", "we", "us") provides bicycle shipping services throughout Europe. These Terms & Conditions govern all shipping services booked through our platform at services.buycycle.com.
Our services are available both to business customers (B2B) and to consumers (B2C). You book as a business customer if you are acting in the exercise of your commercial, business, craft, or professional activity, and as a consumer if you are acting for purposes that are predominantly outside that activity. Where these terms grant rights or protections that apply specifically to consumers, those provisions apply only to customers booking as consumers.
By using our shipping services, you agree to be bound by these terms. If you do not agree to these terms, please do not use our services.
2. Definitions
For the purposes of these Terms & Conditions:
- "Sender" means the person or entity who books the shipping service and hands over the bicycle for transport at the pickup location.
- "Recipient" (or "Receiver") means the person or entity designated to receive the bicycle at the delivery address.
- "Customer" means the Sender who enters into the shipping contract with buycycle and is responsible for payment.
- "Business Customer" means a natural or legal person acting in the exercise of their commercial, business, craft, or professional activity.
- "buycycle" acts as a shipping service provider, arranging and facilitating the transport of bicycles through our network of carrier partners. buycycle is the contractual partner for the shipping service but may engage third-party carriers to perform the actual transport.
- "Carrier" means the third-party logistics company engaged by buycycle to physically transport the bicycle.
3. Contract Formation
3.1 Offer and Acceptance
The display of shipping services and prices on our platform constitutes an invitation to submit an offer (invitatio ad offerendum), not a binding offer. By completing the booking process and submitting your order, you make a binding offer to enter into a shipping contract.
3.2 When the Contract Becomes Binding
The shipping contract becomes binding upon:
- Successful payment processing, and
- Receipt of our booking confirmation email
The booking confirmation will contain all relevant details of your shipment, including the pickup date, estimated delivery window, and your booking reference number. Please verify all details immediately upon receipt.
4. Shipping Services
4.1 Service Description
Our shipping service includes:
- Door-to-door pickup and delivery of bicycles
- Provision of specialized bicycle packaging materials
- Real-time shipment tracking
- Coverage as specified at the time of booking
- Customer support throughout the shipping process
4.2 Eligible Items
Our service is designed specifically for bicycles, including road bikes, mountain bikes, gravel bikes, e-bikes, and similar two-wheeled vehicles. We reserve the right to refuse shipment of items that:
- Exceed our maximum dimensions or weight limits
- Are inadequately packaged
- Contain prohibited materials (including loose lithium batteries)
- Do not qualify as bicycles or bicycle-related equipment
5. Booking and Payment
5.1 Booking Process
Shipments are booked through our online platform. By completing a booking, you confirm that all information provided is accurate and complete. You are responsible for ensuring the pickup and delivery addresses are correct and accessible.
5.2 Pricing
Prices are displayed at the time of booking and include all applicable taxes. The final price is confirmed before payment and depends on the origin, destination, and selected service options.
5.3 Payment
Payment is due at the time of booking. We accept major credit cards and other payment methods as displayed on our platform. All payments are processed securely through our payment provider.
5.4 Carrier Surcharges and Oversize Charges
You are responsible for entering accurate dimensions and weight for your package and for ensuring that your packed box stays within the size and weight limits shown during booking. This is particularly important when you supply your own packaging. Carriers measure and weigh every package in transit. If a carrier determines that a package exceeds the applicable size or weight limits, it applies an oversize or overweight surcharge. We pass this surcharge on to you at cost, capped at €318 per package (or $1,875 for shipments within the United States), and we pass on only the amount the carrier charges us. We will inform you of any such charge. By booking with your own packaging, you acknowledge and accept that these charges may apply if your package exceeds the stated limits.
6. Pickup and Delivery
6.1 Pickup
You must ensure that the bicycle is properly packaged and ready for collection at the scheduled pickup time. The packaging must be suitable for transport and protect the bicycle from damage. We provide packaging materials and instructions; failure to follow these instructions may void damage claims.
6.2 Delivery
Delivery will be made to the address specified during booking. The recipient must be available to receive the shipment. If delivery cannot be completed due to the recipient's unavailability, additional delivery attempts or storage fees may apply.
6.3 Delivery and Pickup Times
All pickup and delivery dates, time windows, and transit times communicated by buycycle (whether at booking, in the booking confirmation, in tracking updates, or otherwise) are non-binding estimates only. They do not constitute guaranteed or fixed dates, and time is not of the essence. Delays may occur due to customs clearance, weather conditions, carrier capacity, road or traffic conditions, sender or recipient unavailability, force majeure, or other circumstances inside or outside our control.
To the maximum extent permitted by law, buycycle accepts no liability for any loss or damage arising from a late, rescheduled, or missed pickup or delivery, or from any delay in transit. This exclusion applies regardless of the length of the delay and includes, without limitation, loss of profit or revenue, missed sales or resale opportunities, missed rental or hire income, missed races, events, holidays, or appointments, the cost of substitute or alternative transport, the hire of replacement equipment, contractual penalties or compensation owed by the Customer to third parties, and any other indirect, incidental, or consequential loss. A delay does not entitle the Customer to withhold payment, cancel a shipment that has already been collected, or claim a refund of the shipping fee.
7. Coverage and Liability
7.1 Premium Protection Coverage
Premium Protection is an optional, discretionary buycycle service that may be added at the time of booking. It is not a regulated financial product. When selected, it tops up the standard carrier liability up to the declared value of the bicycle and helps protect against loss or damage in transit. Premium Protection is provided subject to its own dedicated terms, which apply in addition to these Terms & Conditions. Please read the Premium Protection Terms in full before adding the service.
7.2 Damage Claims
In case of damage or loss, you must:
- Inspect the package upon delivery and note any visible damage on the delivery receipt
- Report damage or loss to us within 7 days of delivery (or expected delivery date for lost items)
- Provide photographs of the damage and the packaging
- Retain the original packaging for inspection if requested
7.3 Limitation of Liability
Subject to the mandatory liability set out in section 8, our liability for loss of or damage to the bicycle is limited to the coverage selected at the time of booking. We are not liable for: (a) damage resulting from inadequate packaging by the sender; (b) inherent defects of the bicycle; (c) normal wear and tear; (d) consequential or indirect damages including loss of profits, missed events, or alternative transport costs; (e) items of extraordinary value not declared at booking.
The limitation and exclusions in this section 7.3 do not affect our liability under section 8, in particular our liability for injury to life, body, or health, for intent or gross negligence, for the breach of essential contractual obligations, or under mandatory statutory provisions such as the German Product Liability Act (Produkthaftungsgesetz).
8. Disclaimer of Liability (Haftungsausschluss)
8.1 General Disclaimer
buycycle is liable without limitation for damages arising from injury to life, body, or health caused by a negligent or intentional breach of duty by buycycle, its legal representatives, or agents; for other damages caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit); for damages covered by a guarantee we have expressly given; and for any liability that is mandatory by law, including under the German Product Liability Act (Produkthaftungsgesetz).
For damages caused by slight negligence, buycycle is liable only where an essential contractual obligation has been breached. An essential contractual obligation is one whose fulfilment is necessary to carry out the contract properly and on whose observance you may regularly rely. In such cases, liability is limited to the foreseeable damage typical for this type of contract. The foreseeable, typical damage of a shipping contract is loss of or damage to the shipment, up to its value; it does not include consequential or indirect losses such as loss of profit, missed sales, rental or resale income, missed races, events, holidays, or appointments, or the cost of substitute or alternative transport. Liability for such consequential losses caused by slight negligence, including losses arising from a delay in pickup or delivery, is excluded. Any further liability for slight negligence is excluded.
The above limitations also apply to the personal liability of buycycle's legal representatives, employees, and agents.
8.2 Exclusions
buycycle shall not be liable for:
- Damages resulting from force majeure, including but not limited to natural disasters, strikes, war, terrorism, pandemics, or governmental actions
- Indirect, incidental, special, or consequential damages, including loss of profits, revenue, business opportunities, or goodwill
- Damages caused by the Customer's failure to comply with packaging instructions or these Terms & Conditions
- Delays or failures in delivery caused by incorrect address information provided by the Customer
- Actions or omissions of third-party carriers, except where buycycle is directly responsible for selection or supervision
8.3 Limitation of Damages
Where buycycle is liable for slight negligence in respect of loss of or damage to the shipment, its liability shall be limited to the value of the coverage selected at booking, or if no coverage was selected, to the shipping fee paid for the affected shipment.
This limitation does not apply to liability for injury to life, body, or health, to liability for intent or gross negligence, or to any other liability that is mandatory by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless buycycle, its affiliates, and their respective directors, officers, employees, carrier partners, and agents from and against any and all claims, demands, liabilities, losses, damages, fines, penalties, costs, and expenses (including reasonable legal fees) brought by any third party and arising out of or in connection with:
- Any claim brought against buycycle by a Recipient, your own customer, or any other third party for loss, damage, or delay relating to a shipment you booked, including claims for missed rentals, missed sales, lost income, or other consequential or business losses
- Your breach of these Terms & Conditions or of any applicable law or regulation
- Inaccurate, incomplete, or misleading information provided by you, including incorrect addresses, contents, or declared values
- Inadequate or non-compliant packaging, or the shipment of prohibited or undeclared items
- Any customs duties, taxes, fines, or charges arising from your shipment
- Any death, personal injury, or property damage caused by the bicycle or its contents during transport, except to the extent directly caused by buycycle's intent or gross negligence
Where you book a shipment on behalf of, or for onward sale or rental to, a third party (for example a customer of your own business), you remain solely responsible to that third party. buycycle's contract is with you alone. You are responsible for any deadlines, commitments, or guarantees you give to your own customers, and buycycle gives no guarantee that a shipment will arrive in time to meet any rental, sale, event, or other commitment you have made to a third party.
This indemnification obligation survives the completion or termination of the shipping contract.
10. Customer Obligations
As a customer, you agree to:
- Provide accurate and complete booking information
- Ensure the bicycle is properly prepared and packaged according to our guidelines
- Remove or secure all loose items, accessories, and detachable components
- For e-bikes: ensure the battery is properly secured and complies with transport regulations, or remove it if required
- Be available at the pickup location during the scheduled window
- Inform the recipient about the expected delivery and ensure someone is available to receive the shipment
- Declare items of extraordinary value (exceeding standard coverage limits) at the time of booking
11. Cancellations and Refunds
11.1 Cancellation by Customer
You may cancel your booking at any time before the shipment has been collected. The amount refunded depends on whether a shipping label has already been generated for your booking:
- Before a shipping label has been generated: you may cancel free of charge and will receive a full refund of the amount paid.
- After a shipping label has been generated, but before pickup: you may cancel, but the cost of the shipping label is non-refundable, as this cost has already been incurred on your behalf. You will receive a refund of the amount paid less the cost of the shipping label.
- After the shipment has been collected: cancellation is no longer possible and no refund will be issued.
If you book as a consumer, the statutory right of withdrawal for distance contracts under Directive 2011/83/EU on consumer rights (and its national implementations, including § 312g of the German Civil Code, BGB) does not apply to our services. This is because contracts for the transport of goods that provide for a specific date or period of performance are excluded from the right of withdrawal (Article 16(l) of Directive 2011/83/EU; § 312g(2) No. 9 BGB). The contractual cancellation and refund terms set out in this section apply instead. Your statutory rights in respect of defective or non-performed services remain unaffected.
11.2 Cancellation by buycycle
We reserve the right to cancel a shipment if: the item does not meet our shipping requirements; the pickup or delivery address is inaccessible; or circumstances beyond our control prevent completion of the service. In such cases, a full refund will be provided.
11.3 Refunds
Refunds are processed to the original payment method within 5-10 business days. Any non-refundable amounts, such as the cost of a shipping label that has already been generated, are deducted as set out in section 11.1. Partial refunds may also be issued in cases of service disruption proportional to the portion of service not rendered.
12. Prohibited Items
The following items may not be shipped through our service:
- Loose or uninstalled lithium batteries
- Flammable, explosive, or hazardous materials
- Illegal substances or items prohibited by law
- Live animals
- Items requiring special permits or licenses for transport
13. Cross-Border Shipments
For shipments between countries, you are responsible for:
- Providing accurate customs documentation
- Declaring the correct value of the bicycle
- Paying any applicable customs duties, taxes, or import fees (unless otherwise specified at booking)
- Compliance with import and export regulations
Shipments may be subject to customs inspection, which can cause delays. We are not responsible for delays caused by customs procedures or for items seized by customs authorities.
14. Data Protection
We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the GDPR. Personal data is collected and processed only as necessary to provide our shipping services and may be shared with our carrier partners for this purpose.
15. Modifications to Terms
We reserve the right to modify these Terms & Conditions at any time. Changes will be effective upon posting to our website. Continued use of our services after changes are posted constitutes acceptance of the modified terms. For existing bookings, the terms in effect at the time of booking will apply.
16. Governing Law and Disputes
These Terms & Conditions are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Munich, Germany.
17. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely achieves the intended economic effect.
